A court in London has decided not to make pre-nuptial agreements binding.
Lawyers had hoped that the country's most senior judges would take the opportunity to declare that agreements signed by a couple ahead of their wedding could be enforced in the event of a divorce if certain conditions were met
Godfrey Morgan described this as ‘a complicated and difficult position, but you need to plan ahead and its worth talking to us if you have arrangements to put in place before tying the knot’.
The decision by Lady Hale, speaking for the Judicial Committee of the Privy Council, said its members "took the view that it is not open to them to reverse the long-standing view that ante-nuptial agreements are contrary to public policy and thus not valid or binding in the contractual sense".
