In a Personal Injury claim, to include a Medical Negligence claim, a Claimant has 3 years from the date of the accident or from date of knowledge to issue the claim at Court.
Usually this 3 year limitation date is obvious – as there is usually an event such as an accident or an operation that went wrong.
However, if the negligence has occurred over some time, such as exposure to Asbestos or if you have been receiving incorrect medication for a number of years, then your 3 period begins from the date that you found out that this was wrong.
In fact, most current Asbestos claims relate to exposure to Asbestos in the 1960s or 1970s and sadly more people are being diagnosed with an Asbestos related condition now than 10 years ago.
In respect of a breach of Contract claim, to include Professional Negligence, you have a period of 6 years from the breach or negligent act to bring a claim. If you have only recently found out about a breach which happened a long time ago, then you have 3 years to take forward a claim.
