Most claims settle before getting anywhere near Court, indeed most claims settle without even needing to issue the claim at Court.
Of the claims that need to be issued at Court, most of these settle before Trial. As such, Trials do not happen very often in modern day litigation – the Courts themselves try and encourage all parties to settle the claim before Trial.
